To the Honorable the Judges of the Court of Common Pleas of Berks County, now composing an Orphans Court, in and for said County.
The Petition of Jeremiah Balthaser one of the sons and heirs of Jacob Balthaser late of the township of Upper Bern in said county, deceased
Humbly showeth, that the said Jacob Balthaser died intestate about four months ago, leaving a widow named Magdalena and issue twelve children, to wit, Sarah (Balthaser) intermarried with Jacob Boyer, Hannah intermarried with Jacob Renno, Jeremiah, Samuel, Jacob, John, Benjamin, Mary intermarried with Benjamin Sundag, George, William, Elizabeth and Susanna, the last three being minors two of whom William and Elizabeth are above the age of fourteen years and Susanna under the age of fourteen years. That the said intestate died, seized in his demense as of fee, of and in the following real estate, to wit, a certain messuage tenement and tract of land situate in Upper Bern township, Berks County, bounded and adjoining lands of Benjamin Seaman, Samuel Rensler, John Sheidy, Jospeh Kauffman, John Georg Shock and others, containing one hundred and eighty two acres, more or less, with the appurtenances. Also a certain messuage tenement and tract of land situate in Upper Bern township of county aforesaid, adjoining lands of Christian Smick, Peter Fink, Henry Hassler and others containing one hundred and sixteen acres and eighty nine perches, with the appurtenances.
Also a certain tract of woodland, situate in Upper Bern township, Berks County, adjoining lands of Michael Rentschler, David Rentschler, John Sheidy, Jacob Yoder and others, containing thirty three acres and one hundred and twenty perches, more or less.
Also a certain tract of land situate in Upper Bern township Berks County adjoining lands of Peter Fink, the Schuylkill Navigation Company and others, containing five acres more or less.
Also a certain tract of sprout land situate in Upper Bern township, Berks County, adjoining lands of John Saeman, George Moyer, Jonathan Seifert and others, containing three acres and sixty nine perches, more or less.
Also a tract of woodland situate in Upper Bern township, Berks county, adjoining lands of George Wagner, Jacob Albright, Jacob Clouser and others, containing three acres and a quarter, more or less, with the appurtenances.
Your petitioner therefore humbly prays your honours to award an inquest, to make partition of the Real estate aforesaid to and among the children and lineal descendants of the said intestate, in such manner and in such proportions, as by the laws of this commonwealth is directed, if such partition can be made without prejudice to or spoiling the whole. But if such partition cannot be made thereof, as aforesaid, then to value and appraise the same, according to law, and make return thereof to the orphans court aforesaid according to law.
And he will pray, etc.
